Having encountered the same issue, I've tested with CONFIG_BT_WAIT_NOP=n on both sides, and that fixes the assertion failure.

An interesting side note is that on the nRF9160-DK, even with CONFIG_BT_WAIT_NOP=y, the assertion only fails during the first boot after powering on, while after resetting the nRF9160 the assertion succeeds.

Could you test something? Try to set CONFIG_BT_WAIT_NOP=n in both the host (lte_ble_gateway) and controller (hci_uart) and see if the error still appears.
