DTM in nRF5 SDK v14.2.0 off spec?

Hi, I have a question regarding DTM in nRF5 SDK v14.2.0. From what I understand Nordic is making use of the payload type '11' = Vendor Specific and is using the length parameter to encode information about the vendor specific functionality. However this packet type was only possible with Core4.0, all newer Core Specs require a 4-bit packet type, where 0011 stands for PRBS15. The Vendor Specific mode is scratched.

How is the DTM implementation still conform to the Bluetooth Spec?

The implementation in the SDK is for UART DTM, see chapter 3.3.2 Commands, Could you be talking about the HCI spec?
