Implication of using ESB, Gazelle or direct nrf_radio access on certification (FCC, ISED)

Hello,

I am currently investigating what the use of the Nordic proprietary protocols (ESB, Gazelle) or an own protocol with direct radio access (similiar to nordic-auko/nRF5-ble-timesync-demo: nRF52 clock synchronization demo code) would imply on the certification needs for FCC, ISED?

We plan to use a pre-certifed module, but the certifications mainly reference Bluetooth and/or IEE 802.15.4.

Can we leverage pre-certifications anyways in case of using proprietary protocols as mentioned above?
