nRF52810 EN 300 328 Annex E (adaptive oder non-adaptive)

Hallo Support Team 
 I have filled out the form in Appendix E.2 in EN 300 328. I have declared the device as "non-adaptive" mentioned in c) as already answered in another place in this forum. But cccording to TÜV, Bluetooth Low Energy should always be declared as "adaptive". Is that correct? 
 Response TÜV Certification Laboratory: " The device is selected as a non-adaptive device, but Bluetooth (Normal and Low Energy) is always adaptive, and then all that has to do with Adaptive should be filled "

 - Should be declared as non-adaptive. This is what we always have done. 
 Definition of BLE non-adaptive: 4.2.2 Adaptive and non-adaptive equipment The present document covers both adaptive and non-adaptive equipment. Adaptive equipment is capable of using an automatic mechanism which allows the equipment to adapt to its radio environment by identifying other transmissions on the operating frequency. N on-adaptive equipment does not use such an automatic mechanism and hence is subject to certain restrictions with respect to using the medium (see clause 4.3.1.6 and clause 4.3.2.5 for Medium Utilization factor) in order to ensure sharing with other equipment.
