FCC : Frequency Channel for Nordic Proprietary vs BLE

nRF52832 offers several different Bluetooth modes such as :

(1) Nordic Proprietary 1 Mbps

(2) Nordic Proprietary 2 Mbps

(3) Bluetooth LE 1 Mbps

(4) Bluetooth LE 2 Mbps

Is 'Nordic Proprietary' a regular Bluetooth (BDR/EDR) with 79 channels and 1 MHz channel separation (hopping) just like regular Bluetooth. Otherwise, is it still BLE category with 40 channel / 2 MHz channel separation ?

Regular Bluetooth is under FCC classification 'DSS', but BLE is under DTS, having different compliance test requirement.

Could anyone advise ?

The different modes relates to the datarate and modulation index only. The protocol, e.g Bluetooth, comes on top of this. BLE will obviously use one of the two BLE modes but if you make your own protocol, you're free too choose. The proprietary modes are mainly for backwards compability
