Is a device that is always advertising when not connected legal?

Are there any laws or regulatory certifications that state a wireless or Bluetooth device must be able to power off or at least stop transmitting through user action? Can I make a product without an off switch but goes to low power advertising when not connected? I know this can be a problem when going on a plane but is it legal?

There is no legal issues of how long a device can advertise. Like Awneil said, beacons are meant to advertise for long periods. If you have battery capacity to do it, then you can do it.
